IMPORTANT NOTICE REGARDING YOUR LEGAL RIGHTS
THESE SUBSCRIPTION TERMS INCLUDE A MANDATORY ARBITRATION PROVISION, A CLASS ACTION WAIVER, AND A JURY TRIAL WAIVER. PLEASE READ CAREFULLY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT SUBSCRIBE.

These Subscription Terms and Conditions (“Subscription Terms”) govern your purchase of and subscription to Sifts products (the “Products”) offered by Gevy Labs, LLC, doing business as Sifts (“Gevy Labs,” “Sifts,” “we,” “us,” or “our”).

By enrolling in a subscription, you agree to these Subscription Terms, our Website Terms and Conditions, and our Privacy Policy, all of which are incorporated by reference. If there is a conflict, these Subscription Terms control with respect to subscription purchases.

You must be at least 18 years old to subscribe.

  1. SUBSCRIPTIONS; AUTOMATIC RENEWAL; AUTHORIZATION

Subscription Enrollment
When you enroll in a Sifts subscription program (the “Program”), you authorize recurring charges until you cancel in accordance with these Subscription Terms.

Automatic Renewal
Your subscription begins when your initial payment is successfully processed and automatically renews at the delivery interval you select (for example, every 30, 60, or 90 days) unless canceled before the next scheduled renewal.

Recurring Charges Authorization
By subscribing, you authorize Sifts and its payment processors to charge your selected payment method on a recurring basis for:

  • The then-current subscription price of your Products, less any applicable discounts
  • Applicable taxes
  • Shipping and handling fees

No additional authorization is required for each recurring charge.

Billing Information
You are responsible for keeping all billing, shipping, and contact information current, complete, and accurate. Failure to do so may result in delayed shipments, failed charges, suspension, or cancellation of your subscription.

  1. PRICE CHANGES

We may change subscription prices at any time. If a price change applies to your subscription, we will notify you in advance and provide an opportunity to cancel before the new price takes effect. Continued participation after the effective date constitutes acceptance of the new price.

  1. PERSONAL USE ONLY

Subscriptions and any included samples are for personal or household use only. Resale, redistribution, or commercial use is prohibited. We reserve the right to cancel or limit subscriptions that appear to violate this provision.

  1. UNAUTHORIZED SELLERS

Sifts Products are intended to be sold only through sifts.co and other channels expressly authorized by us. We are not responsible for Products purchased from unauthorized sellers, including marketplace resellers. Refunds, guarantees, and customer support do not apply to unauthorized purchases.

  1. ORDER ACCEPTANCE

We reserve the right to refuse, cancel, or limit any subscription order in our sole discretion, including for suspected fraud, inventory constraints, pricing errors, or policy violations. Charges generally occur when an order is processed for shipment.

  1. SHIPPING AND DELIVERY

Risk of Loss
Title and risk of loss pass to you when Products are delivered to the carrier.

Address Accuracy
You are responsible for providing accurate shipping information. Orders returned due to incorrect information or non-pickup may incur reshipment or restocking fees.

Delivery Timing
Shipping dates and delivery times are estimates only and not guaranteed. We are not responsible for carrier delays or events outside our control.

International Orders
International shipments may be subject to customs duties, taxes, VAT, tariffs, or fees not included in the purchase price. You are responsible for all such charges. Free shipping promotions generally do not apply to international orders.

  1. CANCELLATION POLICY

How to Cancel
You may cancel your subscription at any time by:

  • Logging into your account and managing your subscription, or
  • Emailing support@sifts.co

Cancellation Timing
Cancellations must be completed at least three (3) business days before the next scheduled renewal or shipment to avoid being charged.

Orders in Progress
If an order has already entered processing or shipment, cancellation will apply to the next renewal cycle.

Our Right to Terminate
We may suspend or terminate subscriptions at any time for suspected fraud, abuse, or policy violations.

  1. RETURNS AND REFUNDS

First Subscription Order Guarantee
If you are not satisfied with your first subscription order, you may request a refund within thirty (30) days of delivery of that first order. Refunds apply to the product price only and exclude shipping, duties, and taxes.

No return shipment is generally required for first-order refunds.

Subsequent Orders
Refunds are not available for refill or renewal shipments after the first subscription order, even if billed or shipped within thirty (30) days of the initial order.

Reactivated Subscriptions
Subscriptions that are canceled and later reactivated are not eligible for an additional first-order refund.

  1. FAILED PAYMENTS AND CHARGEBACKS

If a recurring payment fails, we may retry the charge automatically. Accounts associated with repeated failed payments or excessive chargebacks may be suspended or terminated.

  1. SMS COMMUNICATIONS

If you opt in to SMS communications, you consent to receive transactional and marketing text messages. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. See our Privacy Policy for details.

  1. NO MEDICAL ADVICE

Sifts Products are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease. Information provided by Sifts is for general informational purposes only and is not medical advice. Consult a qualified healthcare professional before use, especially if pregnant, nursing, or under medical care.

  1. DISCLAIMER OF WARRANTIES

THE PROGRAM, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEVY LABS, LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR SUBSCRIPTION OR USE OF THE PRODUCTS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE LESSER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT PAID BY YOU FOR THE SUBSCRIPTION PERIOD GIVING RISE TO THE CLAIM.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Gevy Labs, LLC and its affiliates from claims arising out of your violation of these Subscription Terms, misuse of the Products, or violation of law.

  1. GOVERNING LAW; ARBITRATION; CLASS ACTION WAIVER

These Subscription Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Subscription Terms or the Program shall be resolved by binding arbitration on an individual basis. You waive the right to a jury trial and to participate in class, collective, or representative actions.

Arbitration shall be administered by JAMS under its Streamlined Arbitration Rules and may be conducted remotely.

  1. SEVERABILITY

If any provision is found unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

  1. ENTIRE AGREEMENT

These Subscription Terms, together with our Website Terms and Privacy Policy, constitute the entire agreement regarding subscriptions and supersede prior agreements or understandings.
