TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of https://www.sifts.co (the “Site”) and the purchase of any products or services from Gevy Labs, LLC, doing business as Sifts (“Sifts,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms.

SECTION 1 – ELIGIBILITY

You must be at least 18 years old to use the Site or purchase products. By using the Site, you represent and warrant that you meet this requirement.

SECTION 2 – PRODUCTS AND HEALTH DISCLAIMERS

All products sold by Sifts are dietary supplements.

Statements made on the Site have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Content on the Site is provided for informational purposes only and is not medical advice. You should consult a qualified healthcare professional before using any dietary supplement, especially if you are pregnant, nursing, have a medical condition, or are taking medications.

SECTION 3 – ORDERS AND ACCEPTANCE

When you place an order, you are making an offer to purchase. We reserve the right to accept, reject, cancel, or limit any order in our sole discretion. An order is not accepted until payment is processed and confirmation is sent.

We may cancel orders due to errors, suspected fraud, supply limitations, or other operational reasons. If an order is canceled after payment, we will issue a refund to the original payment method.

SECTION 4 – PRICING AND PAYMENT

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include taxes, shipping, or handling unless stated otherwise.

Payments are processed through Shopify Payments and its supported processors. You represent that you are authorized to use the payment method provided and that all payment information is accurate and complete.

SECTION 5 – SUBSCRIPTIONS AND AUTO-RENEWAL

Certain products are offered as subscriptions. Subscriptions automatically renew at the frequency selected at checkout (every 30, 60, or 90 days) unless canceled.

By purchasing a subscription, you authorize us to charge your payment method on a recurring basis until you cancel.

SECTION 6 – FREE TRIALS AND PROMOTIONAL OFFERS

We may offer free trials or discounted introductory offers from time to time. Unless canceled before the end of the promotional period, such offers will automatically convert to a paid subscription at the stated price.

Specific promotional terms will be disclosed at checkout and are incorporated into these Terms.

SECTION 7 – CANCELLATIONS

You may cancel a subscription at any time by accessing your account dashboard or by emailing support@sifts.co.

Cancellations must be completed before the next scheduled billing date to avoid being charged for the next subscription cycle.

SECTION 8 – REFUNDS

Refunds are handled on a case-by-case basis at our sole discretion. We reserve the right to deny refund requests, including for opened or used products.

SECTION 9 – FAILED PAYMENTS AND CHARGEBACKS

If a subscription payment fails, we may retry the charge automatically. We reserve the right to suspend or terminate accounts associated with excessive failed payments or chargebacks.

SECTION 10 – SHIPPING AND DELIVERY

Orders are fulfilled through third-party fulfillment partners. Shipping times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control.

Risk of loss passes to you once the order is delivered to the carrier.

SECTION 11 – ACCOUNT RESPONSIBILITIES

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may not transfer or assign your account to another person.

SECTION 12 – INTELLECTUAL PROPERTY

All content on the Site, including text, images, graphics, logos, and software, is owned by or licensed to Sifts and is protected by intellectual property laws.

You may use the Site for personal, non-commercial purposes only. Any unauthorized use is prohibited.

SECTION 13 – ACCEPTABLE USE

You agree not to use the Site for unlawful, fraudulent, or abusive purposes, to interfere with Site functionality, to attempt unauthorized access to systems, or to violate applicable laws or regulations.

SECTION 14 – DISCLAIMER OF WARRANTIES

The Site and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

SECTION 15 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Sifts shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or products.

Our total liability shall not exceed the amount you paid for the product giving rise to the claim.

SECTION 16 – INDEMNIFICATION

You agree to indemnify and hold harmless Sifts and its affiliates, officers, directors, employees, contractors, and service providers from any claims, damages, liabilities, or expenses arising from your use of the Site or violation of these Terms.

SECTION 17 – DISPUTE RESOLUTION AND ARBITRATION

Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration on an individual basis. You waive the right to participate in class actions or class arbitration.

SECTION 18 – GOVERNING LAW

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

SECTION 19 – TERMINATION

We may suspend or terminate your access to the Site at any time for any reason. Provisions that by their nature should survive termination shall survive.

SECTION 20 – CHANGES TO TERMS

We may update these Terms at any time by posting a revised version on the Site. Continued use of the Site constitutes acceptance of the updated Terms.
